Definitions

The "COMPANY" refers to Wallis-Smith Ltd, trading as Fritz Fryer Antique Lighting. The "BUYER" refers to the purchaser of goods and services.

Summary

The company only accepts orders subject to the conditions of sale to the exclusion of any condition of the buyer.

Passing of Title and Risk

From the time of delivery, the goods shall be at your risk and you shall be solely responsible for their custody and maintenance as if you were the owner. However, notwithstanding delivery, the property in the goods shall not pass to the buyer until the goods are paid for in full and unconditionally.

Prices

Prices of goods and services supplied as of this date are correct but subject to market fluctuation and revision. Any overseas orders shall be charged to the buyer in UK Sterling (£ GBP) at current exchange rates. The company has no control or liability over these rates.

VAT

The company's price list includes UK sales tax (VAT) where applicable.

Liability

The company's liability to the buyer shall at no time exceed the price of the goods supplied. The company shall be under no liability for any direct loss and/or expense or any indirect loss and /or expense suffered by the buyer or liability to third parties incurred by the buyer. The company shall be under no liability whatsoever for any loss or damage whether direct or indirect resulting from the supply of goods. The company shall be under no liability whatsoever for the quality and purpose of goods supplied to the buyer or to a third party.

Electrical Goods

Please note we do not supply any form of guarantee or certification with our lighting.  Whilst they are all checked and tested (a PAT, portable appliance test, is carried out on each fitting and a PAT label attached), we recommend that you always use a fully qualified or NICEIC approved electrician to fit your lights.

Unless clearly stated otherwise, light fittings are not IP rated and are not suitable for outdoor use or for use in zones 1 or 2 within a bathroom.

Nature of Goods

Unless specified, all goods are to be considered as ‘used’. This means that signs of wear and minor damage are likely to be present. We undertake to mention in item descriptions only those things that may be considered to be of major structural or aesthetic concern. Of course, we will supply detailed condition description on any item on request. All dimensions and weights stated within product descriptions are approximate.

Cancellation

If the goods have been made by the Compnay in response to an order from the Buyer, the Company will not accept cancellation of the order. In the event of the goods ordered by the Buyer not being collected, or delivery not being accepted, the Company reserves the right to destroy or otherwise dispose of such goods after a three month period (during which time clause (7) above will be applied) without reference to the Buyer. Any deposits paid by the Buyer upon placing of an order are non-refundable for any reason whatsoever.

Returns

The company endeavours to photograph all stock accurately and to provide accurate descriptions and dimensions. The Fritz Fryer showroom is open 6 days a week and we encourage customers to come and view our stock in person if they have any doubts as to fitness for purpose.

The company offers a money back guarantee on any items purchased via mail order that the buyer is not entirely happy with with the exception of goods custom made to order for the buyer by the company.

The guarantee is subject to the following terms:

  1. The goods are returned in the same condition as they were sent.
  2. The company receives written notification (postal or email) of the buyer’s intention to return the goods within 7 days of their receipt and that the goods are returned to Fritz Fryer within 28 days of purchase.
  3. The items returned must be well packed. Return postage is at the buyers cost. Any loss or breakages will be the responsibility of the buyer and will result in the guarantee being void.
  4. Any products modified at the request of the buyer and bespoke items cannot be refunded.
  5. We do not accept returns on international transactions.

Lost and Damaged Orders

All orders should be thoroughly examined within 48 hours of receipt and any damaged or missing items including fixtures and fittings notified to the company immediately. Please do not dispose of the damaged goods or packaging as they will be required for insurance purposes.

Restoration

In respect of goods left in trust to the company for purposes of restoration, these are left entirely at the buyer’s risk and the buyer shall assume indemnity for that item/items. Goods entrusted to the company are not insured unless by prior arrangement and the cost of such insurance shall be borne by the buyer. Whilst we take the upmost care of goods entrusted, all work is undertaken entirely at the risk of the Buyer and no liability for loss or damage whatsoever is accepted by Fritz Fryer Antique Lighting.

Please note that any price discussed for restoration is an estimate. Until the work begins it is not always possible to accurately predict the work and/or costs involved.

Currency

The Company only accepts British sterling (£ GBP).
